Ok, wow! I was just driving from best buy to go to my friends house to play some cs, since I haven't been on this weekend. I was driving north and a road with 3 lanes both ways and a turn lane in the middle. There were two cars stopped at the red light going my way. As I was approximately 10-15 car lengths back from the light it turned green. The speed limit is 50mph. I changed lanes into the right lane which was empty and started to accelerate. Just as I got to the light a kid (16-17) walked in front of me and I hit him. I drive a 4 door Chevy S10 4x4. He went up onto the hood hit my window and flew down the road. I called 911 right away and got out see check on him. Freaking the fuck out. His shoes were like another 50 feet down the road. Looking somewhat OK surprisingly He may of had at least one broken leg. I was pulled away to give my statement, and didn't see anything else other then him being put into the ambulance. All said and done I was told front he officer that he was at fault. It was dark/rainy, and he was crossing when it was green for me not paying attention. I know have a busted bug visor, dented ass hood and my head light is hanging out by just the wires.

So I'm left with the question...

I feel bad for him, but I'm also pissed the fuck off about my truck. It was hard for me to even drive home.

WTF! Where do I go from here.

See if he's ok, but also check with your insurance company. I'm not sure how things like that work in the U.S., but here in the Great White North our insurance companies would cover for our sled dogs if they hit a kid. Which reminds me, I gotta speak to my insurance rep. about my igloo...

Seriously tho, I hope that kid is ok and you get your truck fixed through the parents' insurance.

wtf man, this is why you never change lanes when nearing an intersection. accidents like this should not happen. if the insurance company or any other officials find out you changed lanes like that then you're fucked.

I didn't change lanes in the intersection, I change before it was coming up. Its not illegal unless you change lanes in/during intersection.

Corey ... a word of advice. Get the officers badge # and ask if you can have a copy of the accident report. You will need both in case of a court case. Next find a free legal service .. most offer an hour to hear your story and will advise from there. Those are the first 2 steps I would take. I would also inquire at the hospital and go see the kid. Talk to the parents and figure out if they are going to try to take legal action. My 2 cents. Sorry dude for the hassle.

Hey man, I'm currently working with an insurance agency part-time. We have cases like this often; in fact, there is one guy who has been hit by some of our clients a few times so he can get the liability $.

Anyways, most auto insurance policies have comp, collision, and bodily injury/liability limits. These days whether you are at-fault or not, it is your insurance company that will pay for your damages. So for your vehicle, go to your insurance agency and file a claim. Pay the deductible and they will cover the rest of the costs for the car. It sucks, but you will most likely have an increased premium to pay now. Sometimes if its your first accident they may give you grace, but I don't think it happens often. Just check with your insurer and find out.

Next you wanna do exactly what Death said. This kid & his parents may want to sue and they can hire a lawyer to say you were a negligent driver. I know its BS, but people do these things all the time (the kid n family may be very nice people, but lawyers are not). Get the accident report and definitely find out who the officer was at the scene. If the report says you were not at fault and the kid stepped out, etc. then you have a fairly decent case in your favour (assuming they want a settlement from you). However, they can say you were negligent (on a cell phone, drinking from a bottle of water, looking away from the road, anything they can try to use from the report).

Most likely, if they do take you to claims court, they will seek out medical costs, wages lost, and other costs related to rehabilitation. I have no idea how much the medical costs are in the states, but your auto insurance bodily injury limit is usually $1 million or $2 million. If the court rules in favour of the kid n his family, your insurer will cover the costs up to $1 mill or $2 mill depending on what your policy covers you for.

Either way, shit is fucked up. You probably feel good that ya didn't kill the kid but at the same time you're probably WTF'ing at your car + the reversal of circumstances that may come too.

Anything that is unsafe is illegal. When approaching an intersection it's best not to change lanes because you may still be completing that lane change by the time you reach the intersection. This causes confusion on the road and is especially dangerous when changing from the left to the right lane.

When you mention the details Corey, just say that you did your lane change WELL before the intersection, or it can be used against you.
 
I would get a copy of the police report and ask the police if they know how he's doing and if you can send him a Get well card.

The police may advise you that you can have no contact with him or his family for legal reasons etc., but at least then you'll know not to contact him and complicate things.

If it's ok, you can, I would just send a Get Well card filled with a lot of sorry's and Get well wishes, but wouldn't go see him in person. The family is probably upset and something bad might happen. Just a card will do for now.

Talk with the report officer and get a feel from him, if he thinks they can sue you, (any legal legs to stand on etc.) He may say, "Pfff, they have no case, blah blah blah, etc." and that might help relax you a little.

Let's hope the kid is ok too. Please try and send him that card if you are allowed. Take care bud.

you just posted detailed events of what happened here, not a lawyer, does not seem like you did anything wrong, but still, i would probably not make something like this publicly available if in the event it goes to court.

The lanes change was completed plenty before the intersection. The cop told me there was no way he could sue me. I automatically get a copy of the police report and the cops badge number.

Corey, you're fine man. With those two things in hand (make more copies for youself and hide them somewhere in your house so you don't lose it) and a solid case, you have nothing to worry about.

Not to sound cold-blooded here, but there's a reason why there's rules, and walking across a road when the light is red (for the pedestrian) is one of them - you DON'T do it, period! I understand you feel bad, but there is only so much you could do. Unfortunately, you can't make a car fly in a blitz-fast reaction to avoid the person who made the mistake of illegally crossing the road. It's a harsh reality, but also be glad that somebody else's fuck up (the kid who walked across) didn't result in YOU YOURSELF getting fucked up in some tree/post/another car ... be thankful, because you didn't make a mistake. ;) One love, good luck buddy...

dude, the kid might sue you, especially in the US, here its harder to sue. changing lanes is prohibited not only inside the intersection, but also a certain distance before and after !!! (check your state's laws) the kid's hillbilly parents are gonna want some free $$$ from you 4 sure, follow Glock's advice and sue him first, dont be lazy. an OG in never wrong !!
